The Crystal Wytch — Terms of Service

Welcome to The Crystal Wytch (“we,” “us,” “our”). By browsing our website, creating an account, or placing an order, you agree to these Terms of Service and our Refund, Shipping, and Privacy policies. If you do not agree, please do not use the site or place an order.

1. The shop. The Crystal Wytch sells crystals, jewelry, kits, boxes, and related ritual/wellness goods online. We ship from a home studio in California. Product availability, pricing, and descriptions may change without notice.

2. Eligibility. You must be able to form a binding contract in your state (generally 18+) to purchase. By ordering, you confirm the information you provide is accurate.

3. Orders & payment. An order is an offer to buy. We may decline or cancel an order (for example: stock error, pricing error, suspected fraud, or shipping restriction). Payment is due at checkout. Prices are in U.S. dollars and may not include applicable sales tax, which Shopify may calculate and add based on your address and our tax settings.

4. Products are natural. Stones and handmade or curated items vary. Color, size, inclusions, and appearance can differ from photos. We do not guarantee that any item will match a photo exactly.

5. No metaphysical guarantees. Mentions of healing, energy, ritual use, astrology, or spiritual properties are for cultural, educational, or entertainment context only. Products are not medicine, medical devices, or substitutes for professional care. We do not claim any product diagnoses, treats, cures, or prevents disease.

6. Returns & shipping. Purchases are governed by our Refund policy and Shipping policy (all sales final after fulfillment; limited remedies for our mistakes or documented damage; U.S. shipping only at the rates stated there). Those policies are part of these Terms.

7. Subscriptions / recurring kits (if offered). If you subscribe to a recurring product (for example a Pocket Kit), you authorize recurring charges until you cancel according to the instructions on the product page or by emailing us. Cancel before the next billing/ship cycle to avoid the next charge when possible. Missed cancellations may still ship for that cycle under our Refund rules.

8. Intellectual property. Store content — including logos, photos, copy, graphics, and product names — belongs to The Crystal Wytch or its licensors. You may not copy, scrape, resell our images/copy, or use our brand without written permission.

9. Acceptable use. You agree not to misuse the site (fraud, chargeback abuse, scraping, hacking, harassment, or illegal activity). We may refuse service or cancel orders if we believe these Terms are violated.

10. Limitation of liability. To the fullest extent allowed by law, The Crystal Wytch and its owners are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the site or products. Our total liability for any claim related to an order is limited to the amount you paid for that order (excluding shipping), or, where we elect, a replacement or store credit as described in our Refund policy.

11. Indemnity. You agree to defend and hold harmless The Crystal Wytch and its owners from claims arising from your misuse of products, your violation of these Terms, or your inaccurate shipping/account information — to the extent allowed by law.

12. Force majeure. We are not liable for delays or failures caused by events outside our reasonable control, including carrier failures, weather, natural disasters, illness, supply shortages, platform outages, labor disputes, or government actions.

13. Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes should first be raised by email to crystalwytchshop@gmail.com so we can try to resolve them informally. Venue for unresolved disputes is in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.

14. Changes. We may update these Terms or our policies by posting a new version on the site. Continued use after changes means you accept the updated terms. Material checkout policies (refund/shipping) will also appear under Settings → Policies.
